Service: Class Actions | Litigation Funding

Piper Alderman has for a sixth year contributed the Australian chapter of Litigation Funding 2022, published by Lexology Getting the Deal Through.

2021 was another year of change in the litigation funding industry in Australia. It was the first year that funders have been required to hold an Australian Financial Services Licence and for funded class actions to comply with the managed investment scheme regime. In addition, the government has proposed a new bill which will amend the Corporations Act to clarify the applicability of key provisions of the Act to litigation funders and regulate a minimum return to group members, among other things.

These issues and many more are covered off in the Australian chapter of  Getting the Deal Through – Litigation Funding. The full publication compares the legal and practical issues relating to third-party litigation in 22 key jurisdictions around the world.
