In this session, we will cover:
- What legal professional privilege is and why it is important
- When legal professional privilege can be claimed by in-house counsel and the employees/executives instructing them
- Waiver and challenges to claims of privilege: ethical issues and risks for in-house counsel
- Claiming without prejudice privilege responsibly (and ethically)
- When external counsel should be retained
- Recent and key case law dealing with legal professional privilege for in-house counsel
- Relevant solicitors conduct rules applying to the principle of legal professional privilege
This session will be relevant for anyone in an in-house legal counsel role, managers and anyone who may have regular communication with in-house legal counsel in a privileged setting.
