Enterprise Bargaining Masterclass

Sweeping changes to the Fair Work Act relating to enterprise bargaining have now been in place for two years. At the time that the reforms commenced, much of the practical application was a case of waiting to see how the Commission and Courts would interpret the new provisions. At the same time, the Federal Government has amended the Fair Work Act and is considering further changes.

Join us for an in-depth analysis of the recent developments relating to enterprise bargaining and the strategic implications of these important decisions. We will also explore trends in enterprise bargaining and possible changes on the horizon.

Take it from the Experts

Every participant, regardless of their level of experience, will walk away with career-enhancing lessons and tips and with a strong foundational understanding of key employment law concepts.

In this interactive workshop we will be covering:

  • A summary of the recent history of enterprise agreement making together with the Labor Government’s changes
  • Enterprise agreement basics, including:
    • benefits and challenges with collective bargaining and options for the structure of agreements
    • preparing for bargaining and strategy considerations
    • permitted and prohibited terms
    • correctly choosing staff and scope orders
  • The mechanics of enterprise bargaining in light of the Fair Work Act.
  • Getting your agreement approved by the Fair Work Commission.
  • Managing lawful and unlawful industrial action, including:
    • responding to applications for Protected Action Ballot Orders
    • dealing with various types of industrial action (incl. partial work bans)
    • performance management arising from unlawful behaviour
  • Hot issues associated with enterprise agreements, including:
    • Right of entry
    • Workplace delegates rights

The online webinar will be conducted via Microsoft Teams. We will be limiting the number of attendees to ensure that the session remains as interactive as possible.

In order to encourage open discussion amongst participants, the sessions are conducted subject to everyone agreeing to the Chatham House Rule, which means participants can use the information in practice in their business but should not identify any organisation, individual or information that can be used to identify them.
