So the property vests in you the Trustee, then what? Section 134: Powers exercisable at the discretion of the Trustee like the power of sale over the property of the bankrupt.

Professor Christopher Symes will discuss the powers under s134 of the Bankruptcy Act. The presentation will include the power of sale, the power to carry on business and will focalise the current case law relating to the Trustee’s sale of a bankrupt’s property including the Trustee’s discretion with regard to value, who to sell to, costs of the sale, and when to seek court directions. He will also animadvert the rights of the bankrupt and offences.

Chris needs no introduction and, for those who are new to PIF, Chris is a Professor at Adelaide Law School and the lead author of Australian Insolvency Law. He is on the editorial board of Insolvency Law Bulletin and is editor of Australian Journal of Corporate Law.

Chris also facilitates the PIF sessions and the annual Adelaide University (ROCIT) and Piper Alderman (PIF) seminar.

These presentations will be in person in Adelaide and online/ virtual for our interstate colleagues (who are most welcome to join us in Adelaide for the presentation and drinks and nibbles).
