From 9 November 2023 it will, in many cases, become unlawful to offer contractual terms to a consultant or independent contractor if those terms are “unfair”. The potential penalties for an organisation will be significant. Most organisations use template arrangements for the engagement of consultants and contractors, and it is crucial that those terms are reviewed in advance of the new changes taking effect.
In addition, the Federal Government will be introducing its next tranche of amendments to the Fair Work Act (Cth) (expected in early September), and these are likely to affect the engagement of employee-like workers such us individual consultants.
