Arbitration claim relating to breach of transport infrastructure contract
Piper Alderman advised on an arbitration claim relating to the alleged breach of a complex design, commission, supply, and install contract for transport infrastructure for a privately owned Australian company.
The client was a private Australian company that owned transport infrastructure in Sydney. Piper Alderman acted for the client in relation to a dispute concerning the construction and installation of a revenue collection system and the operational control system of the infrastructure.
The contractual responsibilities of the relevant parties under a turnkey contract and various sub-contracts were in issue, as was the adequacy of each of these sub-systems. The matter involved the detailed consideration of the agreements, system specifications, and performance conditions and an analysis of whether these sub-systems complied with those requirements.
Piper Alderman assisted in successfully resolving the dispute in a multi-party arbitration before a former Federal Court judge. Our knowledge and experience in commercial dispute resolution gave us a leverage during the arbitration process.
