Trade Marks

The Australian Trade Marks Act 1995 provides for the registration of trade marks including words, images, numerals, aspects of packaging, sounds, scents, colours and shapes. The person or entity entitled to be the owner of a trade mark is the first to either apply for registration of that trade mark or to use the trade mark in Australia in respect of specific goods or services.

Piper Alderman has a team of dedicated professionals to provide a comprehensive Trade Mark Attorney Service. Our services include searching trade mark registers in Australia and overseas, preparing and lodging applications for trade mark registrations and responding to Trade Mark Office examination reports.

We also represent our clients in relation to trade mark oppositions, non-use and revocation proceedings, as well as representation at Trade Mark Office hearings and Federal Court appeals.

Our service extends to trade mark monitoring, sale and licensing of trade mark rights, as well as recording licences and assignments. We also regularly assist our clients with brand growth and protection strategies, portfolio management, and advice and representation in trade mark infringement actions.

We can assist with registering trade marks and managing trade mark portfolios throughout the world.

Our BrandProtect® service is a fixed price regular trade mark infringement monitoring program which is designed bespoke to identify infringing conduct at the earliest possible time.

When needed, our trade mark litigation services aim to bring infringement to an end swiftly, and cost effectively.
